In 2016, California voters passed Proposition 64 which allows people 21 and older to use cannabis.
On April 19, 2022 and October 11, 2022, the Walnut Creek City Council adopted Ordinance 2216, Resolution 22-16, and Resolution 22-50, amending the City’s cannabis business regulations. These amendments allow for delivery-only retail sales of adult use (recreational) cannabis along with the previously authorized medical use cannabis in the City, and also revise the selection process for cannabis delivery operators within Walnut Creek.
The amendments also allow the operation of up to two (2) additional non-storefront delivery-only cannabis businesses in the City. The application period ran from 8:00 a.m. on June 14, 2023 through 5:00 p.m. on July 14, 2023.
If the City Council selects a proposal, that proposer will be authorized to seek a Conditional Use Permit and Operator Permit as provided in Chapter 10, Part III, Article 2 (Personal and Commercial Cannabis Activities) of the Municipal Code and the Cannabis Operator Selection Procedures Resolution (Resolution 22-16). A selected proposer has six (6) months from selection to obtain a Conditional Use Permit.
Commercial businesses
Walnut Creek allows only non-storefront (delivery-only) cannabis businesses, in two categories: medicinal and recreational. This means that the following business types are not allowed:
- Commercial cultivation
- Distribution
- Manufacturing
- Retail dispensaries
- Testing laboratories
- Cannabis special events
Personal use
Under Proposition 64, it is illegal to use cannabis in public. This includes smoking, vaping, and ingesting edibles. This means it’s illegal to use cannabis in the following places:
- Parks
- Trails
- While driving or riding in a vehicle
- Sidewalks
- Restaurants and bars
Downtown Walnut Creek enforces a smoking ban for tobacco and cannabis.
